Neuropsychiatric Issues in Capacity Evaluations and Probate Work

...With Dr. Jonathan Mueller

NCNF welcomes local neuropsychiatrist Dr. Jonathan Mueller, to present on the complex issues of capacity evaluations. Neuropsychologists are often asked to assess individuals for capacity – often a complicated and involved task. Many different types of capacity exist. Examples include:

Capacity to make medical decisions
Capacity to create a will or trust
Capacity to drive safely
Capacity to live independently

Decision-making capacity is not all-or-nothing. A person diagnosed with dementia or some other cognitive disorder does not necessarily lack capacity. An individual may have the capacity to make certain types of decisions but not others. Furthermore, decision-making capacity can fluctuate, as in the case of a delirium, depression and/or psychosis. Hence, evaluations are complex, layered situation-dependent and raise many questions. Lastly, capacity evaluations are often required in medical-legal cases, and clinicians performing testamentary capacity evaluations face particular challenges. Dr. Mueller will identify seven of those challenges and discuss how to effectively meet them.

Learning Objectives:

1. Distinguish delirium from dementia.

2. Describe 4 of the limitations of the MMSE.

3. List 4 factors that can impact cognitive assessment.

4. Predict and prepare for 7 particular challenges of testamentary capacity evaluations.

Jonathan Mueller, MD., is a co-author of the Cognistat test. Dr. Mueller is a practicing neuropsychiatrist with San Francisco Clinical Neurosciences. He is board-certified separately as a psychiatrist and a neurologist and has two decades of experience assessing older adults and doing probate work.

This program has been approved for 2.0 APA and QME CE credits. NCNF is approved by the American Psychological Association to sponsor continuing education for psychologists. NCNF maintains responsibility for this program and its content.
